Game of Skill: IFAW Tails for Whales Competition

Information on how to enter and prizes forms part of these Conditions of Entry. Entry into the IFAW Tails for Whales Competition ("Competition") is deemed to be an acceptance of these Terms and Conditions.
Promotion commences on 01/05/09 at 9.00am AEST and entries close on 31/07/09 at 11.59pm AEDST ("Promotion Period").
Entry into the IFAW Tails for Whales Competition is only open to Australian residents.
Entrants under the age of 18 will need a parent or guardian to sign the entry form on their behalf.
To enter, Entrants must correctly complete and submit the entry form with their photo submission(s) “Submission”. All Submissions must be supplied on disc or emailed at less than 200K file size as a .JPG or .GIF file Multiple entries will be accepted by the Promoter. The submissions must be sent on disc with entry form to:

By entering this competition, the Entrant warrants that the Submission is your own work; that you have obtain express consent from any person appearing in photos that form part of the work; that if the subject(s) in the photo/s is aged 18 years or younger, that you seek the express consent of the subject's parent or guardian for the subject's image to be used in your Submission and that the Submission does not breach any intellectual property rights of a third party.
Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt. Incomplete or indecipherable entries or files that cannot be viewed by the Promoter will be deemed invalid.
All valid entries received during the Promotion Period will be entered into the judging to be held at IFAW, 8-10 Belmore St, Surry Hills, NSW 2010.
This is a game of skill and chance plays no part in determining the winner.
Eligible entries will also be posted on www.tailsforwhales.org after being assessed for appropriate content for public display. Entry into the competition is deemed to be an acceptance of the terms and conditions of submitting a photo on the Tails for Whales website. Please visit the website to view the terms and conditions www.tailsforwhales.org.
The first three valid individual entries judged to be the most creative and original out of all the eligible entries will win an IFAW prize pack consisting of IFAW top, cap, drink bottle, pen set, plush toy and other items. The total prize value is approximately $100.
The first valid group or community entry judged to contain the largest number of creative and original photos out of all the eligible entries will win a framed whale photograph. The total prize value is approximately $100.
Winners will be notified by phone by 20/8/2008. Judges' decision is final and no correspondence will be entered into.
The total prize value is up to $400 (inclusive of GST).
The Prize cannot be transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the Prize with a prize of equal or greater value (including where the Prize is unavailable).
The Promoter may conduct such further judging at IFAW, 8-10 Belmore St, Surry Hills, NSW 2010 on 31/10/2009. at 1.00pm AEDST, as are necessary for an unclaimed prize. The winners of any unclaimed prize will be notified in writing.
The Promoter's decision is final, and no correspondence will be entered into, including in the event of a dispute. The Prizes must be taken as offered and cannot be varied. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
Any cost associated with accessing the Promotional Website is the entrant's responsibility. Promoter is not responsible for any incorrect or inaccurate information, either caused by Promotional Website users or by any of the equipment or programming associated with or utilised in this Promotion, or by any technical error that may occur in the course of the administration of this Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. No responsibility is accepted for late, lost or misdirected entries or submissions not received for any reason by the Promoter during the Competition Period, or any delays in the delivery of submissions due to technical disruptions, network congestion or for any other reason.
If for any reason this Promotion is not capable of running as planned due to any reason, including but not limited to infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion.
All entries become the property of the Promoter. By entering this promotion you are authorising the Promoter to use your Submission for an unlimited period of time without remuneration for their promotional and marketing purposes.
The winners agree to participate in any news and media/PR activities surrounding the Promotion. The Promoter reserves the right to use each winner's name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant's personal information to administer the Promotion, announce the winners and disclosing the entrant's personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter's privacy policy.
